Managing Sponsor Licence Compliance In A Changing Regulatory Environment

UK sponsors operate within a highly regulated immigration framework requiring ongoing compliance with Home Office sponsor duties and reporting obligations.

Compliance failures may expose businesses to significant operational and regulatory risks, including sponsor licence suspension, revocation, civil penalties, and workforce disruption.

At Britlaw Solicitors, we advise sponsors and employers on maintaining compliant sponsorship systems, managing regulatory risk, and responding to Home Office compliance concerns with careful preparation and strategic guidance.

We work with sponsors across a range of sectors including care, recruitment, hospitality, and skilled worker sponsorship. If you don't yet hold a licence, see our guide to applying for a UK Sponsor Licence, including eligibility, documents and fees.

  • Internal systems support ongoing compliance obligations

We advise sponsors on preparing for compliance activity, identifying risk areas, and strengthening internal sponsor management systems.

Sponsor Licence Compliance FAQs

What triggers a sponsor licence compliance visit?

UKVI can visit at any time, announced or unannounced, but visits are more likely following a new application, a reported change such as an ownership or key personnel change, a spike in Certificate of Sponsorship usage, or a tip-off or referral. Visits check right-to-work processes, HR records and whether sponsored roles match what was reported.

What happens if my sponsor licence is suspended?

Your existing sponsored workers can generally remain, but you cannot assign new Certificates of Sponsorship while suspended. You will receive a written report of the Home Office's concerns and usually have 20 working days to respond before a final decision on downgrade, restoration or revocation.

Can a sponsor licence be restored after suspension?

Yes. If your representations address UKVI's concerns satisfactorily, the licence can be restored to an A-rating, downgraded to a B-rating with an action plan, or in more serious cases revoked. The outcome depends heavily on the quality and timeliness of your response.

What records must a sponsor keep under Appendix D?

Appendix D requires sponsors to retain evidence such as right-to-work checks, copies of a sponsored worker's passport and visa, current contact details, and records of absences and any changes to role, salary or location, typically for at least one year after sponsorship ends.

What changes must be reported to the Home Office and by when?

Sponsors must report relevant changes — such as a worker leaving, a significant change in role, salary or location, or changes to the organisation's structure or key personnel — via the Sponsor Management System, usually within 10 working days of the change. See our fees page for compliance review and mock audit pricing.
